Consecuencias de la operación VENDO de la Guardia Civil.
Como continuación de nuestra publicación, del pasado 28 de febrero sobre las sanciones que está notificando por correo certificado el Comisionado del Mercado para el Tabaco a los estancos, indicaros cual es la situación actual:
Se estima que el número de actas que levantó la Guardia Civil, supera las 1.000, lo que puede convertirse en su Tsunami en el sector, si el Comisionado le dá por dar trámite a todas y cada una de ellas.
Durante los meses de octubre, noviembre y diciembre de 2020 (en plena pandemia), la Guardia Civil llevó a cabo dentro del marco de la denominada “OPERACIÓN VENDO” visitas a las expendedurías de toda España.
Estas visitas se produjeron con la intención de observar si las expendedurías exhibían los productos de forma adecuada y neutral respecto a marcas, fabricantes y distribuidores, considerándose infracción grave para los expendedores el incumplimiento de las normas de publicidad , tanto en el interior como en el exterior.
Las actas que levantó la Guardia Civil fueron acompañadas de un gran número de fotos, realizadas por los propios agentes, tanto del exterior como del interior de las Expendedurías.

Estas actas llegaron al Comisionado durante el último trimestre del año 2020 y hasta hace unos días, no han empezado a dar trámite a los expedientes, tratando que no prescriban las supuestas irregularidades y hacer el «agosto» a costa de los estanqueros.
¿CUÁNDO PRESCRIBEN LAS INFRACCIONES?
Las infracciones muy graves prescribirán a los tres años, las graves a los dos años y las leves a los seis meses.
El plazo de prescripción de las infracciones comenzará a contarse desde el día en que la infracción se hubiera cometido. En el caso de infracciones continuadas o permanentes, el plazo comenzará a correr desde que finalizó la conducta infractora
Según el Art. 30 de la Ley 40/2015, de 1 de octubre, Régimen Jurídico del Sector Público.
¿SON CONOCEDORES LOS FABRICANTES DE ESTA SITUACIÓN ?
Sí, los primeros expedientes sancionadores que se notificaron hace unas semanas, hacían referencia a algunas expresiones puntuales referidas a la prueba gratuita de IQOS, pero las que se están enviando en estos momentos, hacen referencia a las pantallas de publicidad, etiquetas adhesivas, ceniceros publicitarios (éstos tienen más de 15 años).
Los Fabricantes son conscientes de esta situación, porque así se lo han hecho saber los propios estanqueros. Philips Morris ha sido la primera en salir, enviando una circular (pincha aquí para descargártela), en la que muestran su discrepancia con la interpretación que hace el Comisionado.
¿SON CONOCEDORAS LAS ASOCIACIONES DE ESTA SITUACIÓN ?
Sí, tal y como nos han manifestado varios afectados, lo que desconocemos es si están en contacto con el Comisionado para tratar esta situación tan grave e injusta.
El proponer sanciones por parte del CMT, en virtud de las normas que regulan la publicidad, amparándose en el art. 57.6 del Real decreto 1199/1999, de 9 de julio, deja en una situación de indefesión total y absoluta al colectivo de estancos.
Sobre el estanquero no pueden recaer sanciones de este calibre, simplemente por el hecho de acusarles de no cumplir el principio de Neutralidad, principio del todo subjetivo, que es valorado por un agente de la Guardia Civil en una visita al estanco o un funcionario del CMT, cuando elabora un expediente sancionador.
La subjetividad que existe a la hora de analizar que cumple y que no cumple el principio de Neutralidad (cuando entras en un estanco), deja al colectivo de estancos en una situación de inseguridad jurídica impropia de un país como el nuestro, por lo que entendemos (a la vista de las informaciones que nos habéis hecho llegar) que esta situación es de tal gravedad, que se debe atajar lo antes posible, entre los actores del mercado y el Comisionado.
