En las últimas semanas nos han llegado por diferentes medios, las nuevas sanciones que desde el CMT están haciendo llegar a varias expendedurías, el motivo de las mismas es la revisión que se está haciendo desde el CMT de las licencias otorgadas para la venta con recargo al segundo canal y estas pueden llegar hasta los 120.000€.

Si bien es cierto que se está actuando dentro del actual marco legal, nos surgen dos preguntas:

  1. ¿Es moral que una institución pueda validar una autorización, cobrando la tasa correspondiente, y luego hacer una revisión y sancionar si no esta acorde con la norma?
    • Lo normal sería que antes de validar la licencia, la administración correspondiente haga las comprobaciones oportunas, ya que como se ha visto para la inspección posterior si hay herramientas para hacerlo.
  2. Si durante los tres años de validez de la autorización hay cambios que puedan hacer que una expendeduría pase a ser la cuarta expendeduría más próxima a un bar, ¿debe ser el estanco el que sepa que hay un traslado y revise si este le afecta respecto a su parque de máquinas?.
    • Entendemos que al igual que la pregunta anterior debería ser el organismo el que haga las inspecciones necesarias para ajustar la nueva situación a la normativa.

En las consultas que se están realizando hoy día para la reformas de la ley del 98, debería ser tratado este punto que es esencial para la gestión del día a día del colectivo de expendedurías, y exigir al organismo regulador que sea él quien en la validación de la licencia realice las mediciones necesarias para la tramitación de la licencia, y que si hay algún tipo de variación dentro de ese periodo no sea causa de sanción para el expendedor que tiene la licencia en vigor.

Desde el equipo de Estanco al Día deseamos una regulación justa para el colectivo de expendedurías. Basta ya de abusos y de convertir al CMT como un ente puramente recaudador.
