El 25 de marzo la sala de lo Civil y Penal del Tribunal Superior de Justicia de la Comunidad Valenciana (TSJCV) ha absuelto a tres empresarios de Gandia (Valencia) que vendían por internet hojas de tabaco sin procesar importadas desde Bulgaria.
El TSJCV tras estudiar el caso, ha confirmado la decisión de la Audiencia en aplicación de la doctrina del TS sobre supuestos similares, pues el producto comercializado, que se distribuía a los clientes mediante mensajería, no estaba sometido a un proceso de transformación industrial y solo podía ser consumido tras una operación de picado por parte del consumidor final
